1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and BetConfig ("we", "our", or "us") governing your access to and use of our website, software, platform, and related services, including but not limited to our iGaming platform, casino aggregator, sportsbook solutions, and associated APIs and tools (collectively, the "Services"). By registering, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility and Account

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your organisation. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms or pose a risk to the Services or other users.

3. Description of Services

BetConfig provides B2B software and platform solutions for the iGaming industry, including: (a) an iGaming platform for managing halls, providers, payments, and reporting; (b) a casino game aggregator for integrating multiple game providers through a single integration; (c) sportsbook integration and back-office tools; and (d) related APIs, documentation, and support. The exact scope of Services depends on your subscription plan and any separate commercial agreement. We may update, modify, or discontinue features with reasonable notice where practicable.

4. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Services in any jurisdiction where such use is illegal or would cause us to violate applicable law.
• Reverse engineer, decompile, or attempt to extract source code of our software except where expressly permitted by law.
• Circumvent security measures, access controls, or usage limits.
• Transmit malware, spam, or any content that infringes third-party rights or is harmful.
• Resell, sublicense, or redistribute the Services without our prior written consent, unless otherwise agreed.
• Use the Services to compete with BetConfig or to build a substantially similar product.

You are responsible for ensuring that your use of the Services and any content or data you provide complies with all applicable laws, including gambling, data protection, and anti-money laundering regulations in your jurisdiction.

5. Fees and Payment

Fees for the Services are as set out in your order form, quote, or subscription plan. Unless otherwise agreed, fees are due in advance (e.g. monthly or annually) and are non-refundable except as required by law or as explicitly stated in our refund policy. We may change fees upon reasonable notice. Failure to pay may result in suspension or termination of access. You are responsible for any taxes applicable to your use of the Services.

6. Intellectual Property

All intellectual property rights in the Services, including software, design, documentation, and branding, remain the property of BetConfig or our licensors. We grant you a limited, non-exclusive, non-transferable licence to access and use the Services in accordance with these Terms and your subscription. You retain ownership of data you submit; you grant us a licence to use that data as necessary to provide and improve the Services and as set out in our Privacy Policy.

7. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other in connection with the Services. This obligation survives termination. Information is not confidential if it is publicly available (other than through breach), independently developed, or rightfully received from a third party without restriction. We may disclose confidential information where required by law, subject to giving notice where permitted.

8. Data Protection

Our processing of personal data in connection with the Services is described in our Privacy Policy. Where we act as a processor on your behalf, we will process personal data only in accordance with your documented instructions and applicable data protection law, and we will implement appropriate technical and organisational measures. You are responsible for ensuring that your instructions and use of the Services comply with applicable law.

9. Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. You use the Services at your own risk. We are not responsible for the legality of gambling or related activities in your jurisdiction or for your compliance with local laws.

10. Limitation of Liability

To the maximum extent permitted by applicable law, BetConfig and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising out of or in connection with the Services or these Terms. Our total liability for any claims arising from or related to the Services or these Terms shall not exceed the fees paid by you for the Services in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless BetConfig and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any law or third-party rights; or (d) any content or data you provide or actions you take using the Services.

12. Term and Termination

These Terms remain in effect while you use the Services. Either party may terminate in accordance with the subscription or agreement terms, or we may suspend or terminate your access immediately for material breach or if required by law. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive (including fees, intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification) will survive termination.

13. General

These Terms, together with our Privacy Policy and any order form or commercial agreement, constitute the entire agreement between you and BetConfig regarding the Services. No waiver of any provision is effective unless in writing. If any provision is held invalid, the remaining provisions remain in force. We may assign these Terms; you may not assign without our prior written consent. Notices may be sent to the contact details provided in your account or on our website. Governing law and dispute resolution shall be as set out in your commercial agreement or, in the absence thereof, the laws of the jurisdiction in which BetConfig is established, with courts in that jurisdiction having non-exclusive jurisdiction.
